1. Myanmar general information:

Myanmar is a sovereign state located in the Southeast Asian region. Myanmar is bordered by India and Bangladesh to its west, Thailand and Laos to its east and China to its north and northeast. Myanmar is 676,578 square kilometers (261,228 square miles) in size with population of 51 million people. Its capital city is Naypyidaw, and its largest city and former capital is Yangon. Myanmar has been a member of the Association of Southeast Asian Nations (ASEAN) since 1997.

Myanmar is a country rich in jade and gems, oil, natural gas and other mineral resources. Recently, the United States and European Union eased most of their sanctions that led to an uptrend of foreign investment which comes primarily from Japan, China, Singapore, the Philippines, South Korea, India, and Thailand.

2. Myanmar legal framework:

(i) Registration:

So far, there has been no IP Law in Myanmar. Patents, designs and trademarks can be registered by filing  Declaration of Ownership at the office of the Registrar. The trademark owners can also publish Cautionary Notice to inform about the the apprearance of their IP subjects in Myanmar.

(ii) Renewal:

In Myanmar, once registration is valid so long as the owner keeps on using of it and shows no sign of abandoning their trademark. However, it is advisable to renew in registration every three years and it becomes established practice In Myanmar, renewal is usually done every after (3) years from the date of registration here. It is established practice to renew the registration in every three years to make the ownership and the owner's right more forceful in case of litigation at a court. Renewal of registration in every three year shows that the owner is still using the registration and the owner’s constant interest upon the IP subject. Renewal date is usually count from its registration date. However, law does not enact the exact renewal date nor the deadline for renewal.
