IP procedures overview

As Vietnam IP Law came into effect in 2006, IP is regarded as a new field in the country. Among IP procedures such as IP right acquisition (particularly filing new applications), recordal of change/assignment, opposition, cancellation, appeal or infringement resolution, IP right acquisition is dominant. However, the most concern of foreign applicants when filing patent, trademark and design applications is the long examination time of the Intellectual Property Office of Vietnam due to the lack of modern technology and human resources for examination. The time for examination can be estimated as below:

☑️ Time from filing until registration for trademarks: about 26-30 months;

☑️ Time from filing until grant for industrial designs: about 18-24 months;

☑️ Time from filing until grant for patents: about 3.5-4 years.

Although there is such an obstacle, our firm has our own solution by standardizing procedures for our IP system from search, filing, prosecution and facilitation so that we can assist clients to successfuly obtain and protect IP rights in Vietnam.
